In this paper, we examine the scientific, legal, and ethical foundations for inclusion of transgender women athletes in competitive sport, drawing on IOC principles and relevant Court of Arbitration for Sport decisions. We argue that the inclusion of trans athletes in competition commensurate with their legal gender is the most consistent position with these principles of fair and equitable sport. Biological restrictions, such as endogenous testosterone limits, are not consistent with IOC and CAS principles. We explore the implications for recognizing (...) that endogenous testosterone values are a ‘natural physical trait’ and that excluding legally recognized women for high endogenous testosterone values constitutes discrimination on the basis of a natural physical trait. We suggest that the justificatory burden for such prima facie discrimination is unlikely to be met. Thus, in place of a limit on endogenous testosterone for women, we argue that ‘legally recognized gender’ is most fully in line with IOC and CAS principles. (shrink)

Uno de los factores fundamentales para comprender la problemática de la paz es el de la memoria. Un presupuesto de este artículo es que dicha memoria se realiza en el lenguaje, especialmente en el lenguaje articulado, que es el medio por el que se hace púbica y se despliega, no sólo la expresión de un pasado, sino también las perspectivas que orientan nuestras argumentaciones para el presente y el futuro. Cuando hablo de lenguaje, propongo que de lo que se trata, (...) no son sólo de palabras, sino de sintagmas, es decir del habla desplegada en una época, y en contextos biográficos y comunidades interpretativas de cada uno y de cada comunidad. Dos factores a considerar en esta definición de nociones, categorías y conceptos son lo imaginario y la ideología, que están relacionados con la educación y las condiciones de vida, colectivas e individuales.Otro asunto que hay que considerar son los contextos o niveles de diversa escala y poder, entre ellos, los contextos contemporáneos, es decir la escala macro-estructural ─escala preferida de quienes piensan que la paz no es posible─, que interviene decisivamente en la formulación de las posibilidades no sólo de la paz, sino de la memorialización, la que puede ser sometida a políticas públicas y privadas de diverso alcance.En este artículo se abordan los problemas asociados a las posibilidades de formulación de las políticas de paz en su nivel intermedio, es decir las que median entre las escalas macro y micro, con especial énfasis en las últimas, que es donde la memoria, la acción colectiva y la autoreflexividad pueden aportar. At the outset of an ethnographic inquiry, we navigated national and international resources to search for theoretical and practical guidance on obtaining parents and children’s informed consent/assent. While much theoretical guidance debating ethical issues to children’s participation in research was found, a paucity of published papers offering practical guidance on assent processes and/or visual representations of child assent forms and information sheets was discovered. The purpose of this article is to describe our experiences, both theoretically and practically, of negotiating the (...) process of obtaining informed consent and assent with parents and children for a non-therapeutic qualitative research study. We hope this article instigates a platform for others to explicate their experience and contributes to the construction of a coherent body of knowledge which will clearly delineate important elements that must be considered when negotiating children’s agreement to participate in research. This article examines the application of the ought‐implies‐can principle in the legal domain, especially in the relationship between obligations and responsibility. It addresses the challenge of cases in which an agent cannot do what is required of her, and yet it seems plausible to say that she has an obligation. To deal with these cases, two parallel distinctions are made: between rules of conduct and rules of imputation, and between doings and things done. I’ve already argued for the legal, ethical, and scientific basis for full and equal inclusion of trans and intersex women in women’s sport. In this paper, I want to analyze what I take to be a representative selection of recent arguments against full and equal inclusion of trans and intersex women in women’s (...) sport. In short, these arguments tend to be based on mere assumption, unsupported “common sense,” straw arguments, fallacious question begging, and a number of hypotheticals and unsupported counterfactuals rather than established fact. Deep brain stimulation (DBS) is a developing technology. New generations of DBS technology are already in the pipeline, yet this particular fact has been largely ignored among ethicists interested in DBS. Focusing only on ethical concerns raised by the current DBS technology is, albeit necessary, not sufficient. Since current bioethical concerns raised by a specific technology could be quite different from the concerns it will raise a couple of years ahead, an ethical analysis should be sensitive to such alterations, or (...) it could end up with results that soon become dated. The goal of this analysis is to address these changing bioethical concerns, to think ahead on upcoming and future DBS concerns both in terms of a changing technology and changing moral attitudes. By employing the distinction between inherent and noninherent bioethical concerns we identify and make explicit the particular limits and potentials for change within each category, respectively, including how present and upcoming bioethical concerns regarding DBS emerge and become obsolete. Many of the currently identified ethical problems with DBS, such as stimulation-induced mania, are a result of suboptimal technology. These challenges could be addressed by technical advances, while for instance perceptions of an altered body image caused by the mere awareness of having an implant may not. Other concerns will not emerge until the technology has become sophisticated enough for new uses to be realized, such as concerns on DBS for enhancement purposes. As a part of the present analysis, concerns regarding authenticity are used as an example. (shrink)

Divided into three parts on the conceptual framework, the logical foundations, and the applications, this monograph takes the reader for a comprehensive and erudite tour through the taxonomy of abductive reasoning, via the logical workings of abductive inference ending with applications pertinent to scientific explanation, empirical progress, pragmatism and belief revision.

The presence of stigmatizing language in the electronic health record (EHR) has been used to measure implicit biases that underlie health inequities. The purpose of this study was to identify the presence of stigmatizing language in the clinical notes of pregnant people during the birth admission. We conducted a qualitative analysis on N = 1117 birth admission EHR notes from two urban hospitals in 2017. We identified stigmatizing language categories, such as Disapproval (39.3%), Questioning patient credibility (37.7%), Difficult patient (21.3%), (...) Stereotyping (1.6%), and Unilateral decisions (1.6%) in 61 notes (5.4%). We also defined a new stigmatizing language category indicating Power/privilege. This was present in 37 notes (3.3%) and signaled approval of social status, upholding a hierarchy of bias. The stigmatizing language was most frequently identified in birth admission triage notes (16%) and least frequently in social work initial assessments (13.7%). We found that clinicians from various disciplines recorded stigmatizing language in the medical records of birthing people. This language was used to question birthing people's credibility and convey disapproval of decision‐making abilities for themselves or their newborns. We reported a Power/privilege language bias in the inconsistent documentation of traits considered favorable for patient outcomes (e.g., employment status). Future work on stigmatizing language may inform tailored interventions to improve perinatal outcomes for all birthing people and their families. (shrink)

This work analyzes how the internal point of view, which represents the perspective of the participant in the legal domain, can be understood within a Hartian framework. It critically examines how legal conventionalism has dealt with this issue. In particular, it criticizes the way in which contemporary conventionalists represent the perspective of participants in legal practice on the basis of cognitive mental states. It also criticizes the way in which they understand how the rule of recognition constitutes the practice. Starting from this hypothesis, directly connected to the subjective modality of “living” the time and defined as time perspective, we will try to understand how much it affects the various domains of people's lives, attitudes, and experiences. Therefore, the research investigates whether all our decisions can be influenced by one or more time perspectives beyond our awareness. Remote work became the new normal during COVID-19 as a response to restrictions imposed by governments across the globe. Therefore, remote work’s impact on employee outcomes, well-being, and psychological health has become a serious concern. However, the knowledge about the mechanisms and outcomes of remote work is still limited. In this study, we expect remote work to be negatively related to bullying and assume that bullying will mediate remote work’s impact on work engagement and loneliness. To test our hypothetical model, (...) we applied a cross-sectional design using data from a large representative sample of 1,511 Norwegian workers. The data were collected in September 2021 during a period of COVID-19 restrictions in Norway. The results confirmed our hypotheses: remote work was positively related to loneliness and work engagement but negatively related to bullying. Further, bullying was positively related to loneliness and negatively related to work engagement. Moreover, bullying was also found to play a partial mediating role, supporting our hypothesis. This study suggests that remote work is related to both positive and negative mechanisms in the workplace. Remote work can potentially reduce bullying and have a protective function in preventing bullying. However, since remote work has positive relations with both loneliness and work engagement, this study illustrates that organizations should be cautious and perhaps consider a moderate level of remote work. The case of Charlie Gard sparked an ongoing public and academic debate whether in court decisions about medical treatment for children in England & Wales the best interests test should be replaced by a harm threshold. However, the literature has scantly considered (1) what the impact of such a replacement would be on future litigation and (2) how a harm threshold should be introduced: for triage or as standard for decision-making. This article directly addresses these gaps, by first analysing reported (...) cases in England & Wales about medical treatment in the context of a S31 order, thus using a harm threshold for triage and second comparing court decisions about medical treatment for children in England & Wales based on the best interest test with Dutch and German case law using a harm threshold. The investigation found that whilst no substantial increase of parental discretion can be expected an introduction of a harm threshold for triage would change litigation. In particular, cases in which harm is limited, currently only heard when there are concerns about parental decision-making, may be denied a court hearing as might cases in which the child has lost their capacity to suffer. Applying a harm threshold for triage in decisions about withholding or withdrawing life-sustaining treatment might lead to a continuation of medical treatment that could be considered futile. Resumen: De acuerdo con los principales enfoques al respecto (Sexto, Diógenes Laercio, Galeno, B.Mates, Long, Bochenski, Lukasiewicz) la lógica (dialéctica) de los estoicos es principalmente un sistema deductivo, lo que, en términos actuales, ha sido visto como un sistema de lógica proposicional. La obra de Crísipo acerca de los cinco argumentos indemostrables constituye la principal base de dicho sistema. En este artículo se examina la naturaleza de dichos cinco indemostrables así como el llamando teorema de Antipatro y los esquemas básicos (...) de inferencia, o zemas. Por otra parte y en particular, sostengo que dichos argumentos indemostrables tienen otro importante rol para la filosofía y la historia de la lógica, cual es el de constituirse en una justificación de la deducción, un problema central en el presente. Se analiza, primero, la justificación por los indemostrables y por el principio de condicionalización y, segundo, la justificación cognitiva de la lógica implícita en un sistema estoico.Palabras clave: Crísipo de Solós; lógica; indemostrable; justificación; validez. From a systematic review, points of view have been collected considering the medical and social fields. Multiple divergences were found in these views depending on the countries, resources, religious approaches, and political aspects that have been adapted according to the circumstances of each nation. The internet offers adolescents a huge window of opportunities, but these opportunities are not always exempt from risks. Indeed, many young people are nowadays confronted with spam, gruesome or violent images and content including pornography, drugs, racism, and even suicide. We surveyed 815 Flemish 15- to 19-year-olds about the online risks they have been confronted with and on how they cope with these risks. We controlled for digital literacy levels, socio-demographics and personality traits. Interestingly, our research shows that not only (...) adolescents with a high level of internet literacy but also those with lower internet literacy levels, such as youths enrolled in vocational education, tend to be more frequently exposed to online risks. Also worthwhile noting is the fact that a high level of self-confidence positively correlates with exposure to risky online content. In general, adolescents do not consult anybody when it comes to coping with risks and negative experiences online. However, a good parent-child relationship pays off as kids with a good parental relationship encounter aggressive, sexual or value-based content less frequently. (shrink)

Este artículo constituye un avance de la biografía completa de Francisco de Paula de Arrangoinz y Berzábal (1811-1892). Se trata de un personaje enigmático y que hasta la fecha quienes lo han tratado no señalan correctamente los datos biográficos duros, como su nacimiento y muerte. Con el fin de situarlo y comprender su origen social y su trayectoria, se abarcan los años 1799 a 1846. Se estudian sus antecedentes familiares, su formación académica y sus dos primeras misiones consulares en fuentes (...) primarias inexploradas, profundizando en los periodos menos conocidos. Se incluye un corolario en el que se revisa someramente el periodo de 1847 hasta su fallecimiento en 1892. La información referente a sus últimos días también constituye una novedosa aportación. Se ha señalado que aun si la reducción es empleada en este texto, no lo sería en su “versión madura”. Se busca determinar el estatus metodológico de las Lecciones a partir de una comparación entre los desarrollos metódicos (...) y las descripciones fenomenológicas que se presentan allí y aquellos consignados en Investigaciones e Ideas, teniendo como idea regulativa el esclarecimiento del papel del tiempo en la ampliación del dominio de la fenomenología como conjunto. The aim of this study was to explore the existence of moral distress among nurses in Lilongwe District of Malawi. Qualitative research was conducted in selected health institutions of Lilongwe District in Malawi to assess knowledge and causes of moral distress among nurses and coping mechanisms and sources of support that are used by morally distressed nurses. Data were collected from a purposive sample of 20 nurses through in-depth interviews using a semi-structured interview guide. Thematic analysis of qualitative data was (...) used. The results show that nurses, irrespective of age, work experience and tribe, experienced moral distress related to patient/nursing care. The major distressing factors were inadequate resources and lack of respect from patients, guardians, peers and bosses. Nurses desire teamwork and ethics committees in their health institutions as a means of controlling and preventing moral distress. There is a need for creation of awareness for nurses to recognize and manage moral distress, thus optimizing their ability to provide quality and uncompromised nursing care. (shrink)
